| How to become a Patent Agent or Attorney Some key information about the career of patent agent
Rights of patent agents (Section 127) 1. to practice before the Controller; and 2. to prepare all documents, transact all business and discharge such other functions as may be prescribed in connection with any proceeding before the Controller under this Act. He/She may sign all applications and communications to the Controller. His/Her work also includes drafting of patent specification, making an application for Patent, making subsequent correspondence with the Patent Office, attending hearing on behalf of the applicant, filing and taking part in opposition proceeding or defending his case against such opposition filed by some other party. Qualifications for registration as patent agents (Section 126) (a) He/She is a citizen of India; (b) He/She has completed the age of 21 years; (c) He/She has obtained a degree in science, engineering or technology; d) He/She has passed the qualifying examination conducted by the patent office Particulars of the qualifying examination for patent agents (Rule 110) The qualifying examination consists of the following papers and marks Paper I —Patents Act and Rules 100 marks Paper II—Drafting and interpretation of patent specifications and other documents 100 marks Viva Voce 100 marks The qualifying marks for each written paper and for the viva voce examination shall be fifty per cent (50 marks) , each, of total marks and a candidate shall be declared to have passed the examination only if he obtains an aggregate of sixty per cent (180 marks), of the total marks (300 marks). The qualifying examination for Patent agents will be held twice in a year i.e, in the month of February and August, at each of the appropriate office of the Patent Office. Application for qualifying examination Application for the qualifying examination shall be made on plain paper addressed to "The Controller of Patents" in the prescribed manner along with requisite fee in cash / cheque / D.D. in favour of "The Controller of Patents" and shall be submitted to the nearest Patent Office (Chennai for south India) along with two copies of passport size photos and with relevant documents. Rule 111. Registration of patent agents.- After a candidate passes the qualifying examination specified in rule 110 and after obtaining any further information which the Controller considers necessary he shall, on receipt of the fee specified therefore in the First Schedule with Form 22, enter the candidate's name in the register of patent agents and issue to him a certificate of registration as a patent agent. \“ A nation\’s ability to knowledge into wealth and social good through the process of innovation will determine its future\”
